Amateur Radio Club

Name
The name of the club is the BYU Amateur Radio Club.
Purpose and Objectives
The BYU Amateur Radio Club will uphold the standards of BYU by expecting honorable conduct of its members and examples worthy of the ideals taught by the Church of Jesus Christ of Latter Day Saints. In particular, violation of FCC regulations, or any other irresponsible conduct would be sufficient reason for the revoking of equipment access privileges.
Mission Statement
The club will pursue the following goals:
- Recognition and enhancement of the value of the amateur service to the campus and community as a voluntary noncommercial communication service, particularly with respect to providing emergency communications.
- Continuation and extension of the amateur's proven ability to contribute to the advancement of the radio art.
- Encouragement and improvement of the amateur service through rules which provide for advancing skills in both the communication and technical phases of the art.
- Expansion of the existing reservoir within the amateur radio service of trained operators, technicians, and electronics experts.
- Continuation and extension of the amateur's unique ability to enhance the international goodwill.
Organization Structure
The executive committee of the BYUARC consists of a President, President-elect, and Secretary-Treasurer, as well as any other chairmen or heads of committees deemed necessary. The first three must be appointed by election, while the auxiliary positions may be elected or appointed by the executive committee.
The President shall:
- be the liaison to the faculty advisor (see Club Advisory below) as well as all other campus departments, except as he/she finds appropriate to delegate head the executive committee mentioned previously.
The President-elect shall:
- assume the duties of the president in his/her absence
- direct other areas of special interest as assigned by the executive committee
- become President after an election
The Secretary/Treasurer shall:
- keep record of club financial transactions and material assets
- handle club correspondence
- record results of all club business
Elections:
- Elections are to be held in March or April every year, and as often as necessary in the event of a current or imminent vacancy of an elected position. The membership may also initiate a reelection anytime a majority consents to doing so if they are dissatisfied or for any other reason fell it appropriate to do so.
- Elections are to be held for the offices of President-elect and Secretary/Treasurer; after the election, the office of President will be assumed by the member who was President-elect prior to the election. In the event that the previous President-elect is unable, unwilling, or ineligible to assume the office of President, the election will include the office of President.
- Candidates are to be nominated by the membership body and elected by a majority vote. In the unlikely event that more than two candidates split the vote, the candidate with the least votes shall be dropped and a re-vote taken, repeating until a candidate has a majority.
- Only club members in good academic, disciplinary and club standing are eligible for holding office.
Membership Requirements
Club membership is open to all BYU students, employees, alumni, and their spouses, excepting those who have been denied membership previously for any of the reasons designated by this constitution.Due to the special nature of this club, and to allow for valuable contribution of talent and knowledge from the community and even non-university affiliated persons may also, under special consideration by the executive committee and trustee, be granted membership.
Inasmuch as the Federal Communications Commission prohibits operation of amateur radio equipment except by persons properly licensed, full operating privileges of the BYU ARC facilities will be contingent upon a persons holding of such a valid license.
Operation privileges are extended in strict accordance to FCC regulations. BYU ARC officers reserve the right to protect the club from federal citation due to improper or illegal operations of either licensed or unlicensed operators by restricting or suspending membership privileges of anyone found violating these regulations. Action may likewise be taken against anyone operating not in accordance with existing club rules as posted or usage limitations as specified by the agreement of membership provided at induction.
Club Advisor
The advisor must be a full time member of BYU faculty or staff, must be kept aware of the financial status of the club, and may advise in these matters. The advisor should be available as an advocate for the club in the event of problems. The advisor must be made aware of how to reach the club president, and be willing to meet as needed.
Trustee
The club station license may only be issued to a named individual. This individual may be any responsible citizen who holds the requisite license as stipulated under part 97 of FCC regulations.
Finances
Dues are to be set by the executive committee and require approval by vote of the membership. Dues may be adjusted once yearly, if necessary, to appropriately accommodate club needs. Dues shall, in any event, not exceed the limit imposed on BYUSA chartered clubs -- currently $30 per semester and $10 per term.
Club funds shall be used as directed by the executive committee, with the stipulation that purchases over $50 be ratified by majority vote of the membership. No funds shall be expended as remuneration for labor by any member without the approval of the membership.
All funds shall be kept in a regular BYU Agency account.
Amendments
This constitution may be amended at any time such amendment is approved by the majority of the membership as long as such change is permissible under BYUSA charter guidelines. However, when members are notified at least two weeks prior to a club meeting that motions will be discussed and voted upon which affect changes in membership or constitution wording, a 2/3 majority of those voting members present at that meeting is sufficient to pass these motions.
Motions in Meetings
Motions in club meetings can be passed with a majority of vote of those present if the motion does not affect the constitution or the membership of the club. These motions must be approved by a majority of the club membership.
